Membership Terms

SCMP Wine Circle (“Wine Circle”) is a community for wine lovers which is managed and operated by South China Morning Post Publishers Limited (“Company”).

These Terms and Conditions govern the Company’s relationship with the Wine Circle members (“Members”).


Enrolment

The Wine Circle is open to any individual aged 18 years or over who has a valid Hong Kong address. An individual can only have one Wine Circle account at one time. Joint accounts or multiple enrolments by any person are not allowed. Membership of the Wine Circle (“Membership”) is not available to corporations or other legal entities.

The Company reserves the right to grant or refuse Membership at its sole and absolute discretion.

You may apply for Membership online at winecircle.scmp.com (“Website”). Membership is free of charge.

By enrolling, Members will be deemed to have accepted these Terms and Conditions and the Website Usage Terms (Please click here for our Website Usage Terms.)


Membership

Membership is non-transferrable and may only be used by the Member.

The Company may amend and/or terminate the Wine Circle, its benefits, privileges and/or its other features, including these Terms and Conditions, at any time without prior notice.

Any modification to these Terms and Conditions and/or amendments or termination of the Wine Circle will be posted on the Website. Any use by a Member of the Wine Circle and/or the goods or services which it offers will be deemed to be acceptance of such modification to these Terms and Conditions and/or such amendments to the Wine Circle, whichever applicable.

The Company reserves the right to terminate or suspend any Membership at its sole and absolute discretion without prior notice. Upon termination, all benefits and privileges of the Member shall cease and all unused e-vouchers and other benefits will become void unless the Company agrees otherwise.

In case of any dispute arising in connection with the Wine Circle and/or Membership (including without limitation, validity of Membership and Members’ rights and obligations), the Company retains the right to make the final decision. In this regard, each Member hereby waives and agrees to release the Company from any and all claims for direct or indirect loss, costs, damages or expenses of any kind whatsoever and howsoever arising out of or in connection with the Wine Circle (including without limitation, any refusal to provide any benefits or privileges or use of e-vouchers) to the extent permissible under law.


Membership Benefits

There are two types of membership.


1. Regular Member

Any individual aged 18 years or over with a valid Hong Kong address who is interested in joining the Wine Circle but does not intend to purchase wine products on this Website can apply to be a regular member.

A regular member will: (i) receive our e-newsletters regarding the latest wine-related news and blogs from wine experts; and (ii) be invited to our wine-tasting and other events exclusively for Members.

You will need to provide your name and email address to join as a regular member. We do not assign a membership number to a regular member.

A regular member will automatically be upgraded to be a privileged member as and when he/she purchases wine products on this Website for the first time.


2. Privileged Member

Any individual aged 18 years or over with a valid Hong Kong address who is interested in joining the Wine Circle and purchasing wine products on this Website can become a privileged member.

A privileged member will: (i) receive our e-newsletters regarding the latest wine-related news and blogs from wine experts; (ii) be invited to our wine-tasting and other events exclusively for Members; and (iii) enjoy special offers of special wine packages from Kerry Wines Limited and/or other products/services of our business partners.

You will need to provide your name, address, phone number, email address and credit card details to join as a privileged member (and for processing and fulfilling your wine products purchase orders).

A regular member will have customer number which is assigned on the first occasion that he/she purchases wine products on this Website.

E-vouchers may be offered by the Wine Circle to its Members from time to time and may be redeemed by Members when purchasing certain products from the Wine Circle. E-vouchers are non-negotiable, non-transferable, non-assignable and not redeemable for cash and are void if sold for cash or other consideration, assigned or transferred.

Members who wish to discontinue their Memberships must provide written notice to the Company at which time all benefits and privileges of the Members shall cease and all unused e-vouchers and other benefits will become void.


Privacy Policy

The Company requires Members to provide certain personal data in order to become members of the Wine Circle and enjoy Membership benefits, otherwise the Company cannot process your Membership application and/or provide its services to the Members.

In relation to the above, the Company is not responsible for any loss or failure to deliver any Membership benefits or privileges as a result of a Member’s failure to provide the Company with up-to-date personal information.

The Company’s privacy policy (“Privacy Policy”) can be found on the Website and is deemed to be incorporated into these Terms and Conditions. All personal information submitted by a Member to the Company will be managed in accordance with the Privacy Policy. Please read our Privacy Policy by clicking here.


Governing Law

These Terms and Conditions are governed by and shall be construed in accordance with the laws of Hong Kong. Each Member agrees to submit to the non-exclusive jurisdiction of the Hong Kong courts.


Miscellaneous

In the event of any provision of these Terms and Conditions being found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and Conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

These Terms and Conditions are written in the English language and may be translated into Chinese. In the event of any inconsistency between the English version and the Chinese version, the English version shall prevail.
